2. The Name of the Register

The name of the register is The Customer register of Emperosa Oy.

3. The Purpose of Processing Personal Data

Personal data is processed for purposes related to the management, administration and development of the customer relationship, the provision and delivery of services, the development of services and invoicing. Personal data is also processed for the purposes required to clarify possible complaints and other claims. In addition, personal data is processed in customer related communication, such as information and news communication, and in marketing. As part of marketing, personal data is also processed for purposes related to direct marketing and electronic direct marketing. The customer has the right to prohibit direct marketing directed at her/him. The controller of the register processes the data by him-/herself and uses subcontractors acting on behalf and for the account of the controller in the processing of personal data.

4. The legal bases of processing

The legal bases for the processing of personal data are the following, in accordance with General Data Protection Regulation (hereinafter also “GDPR”) of European Union:

 the data subject has given consent to the processing of his or her personal data for one or more specific purposes (GDPR 6 art. 1.a);

 processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract (GDPR 6 art. 1.b);

 processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child. (GDPR 6 art. 1.f). Above-mentioned legitimate interests of a controller is based on a relevant and appropriate relationship between the data subject and the controller, where the data subject is a client of the controller, and processing takes place for the purposes for which subject can reasonably expect at the time and in the context of the collection of the personal data that processing for that purpose may take place.

5. Data content of the register (categories of personal to be processed)

The register contains, in principle, the following personal data on all registered persons:

 basic information and contact information of the person: first name, last name, address, phone number and email address,

 information related to the person's company or other organization and the person's position or job title in a company or organization in question,

 direct marketing permits and prohibitions of the person.

6. Regular Sources of Information

The personal data is collected from registered person him-/herself. The personal data is collected and updated also within the limits of applicable law, from publicly available sources, which relate to the implementation of the customer relationship between the controller and the data subject and through which the controller fulfills its responsibilities related to maintaining customer relationship.

7. The period for which the personal data will be stored

The data collected in the register shall be stored only for as long and to the extent necessary in relation to the original or compatible purposes for which the personal data were collected. The need to store personal data will be assessed every five years. In any case the data of registered person will be removed from the register two years after the end of the customer relationship of the data subject with the controller, and the obligations and measures related to customer relationship are completed. For example, accounting documents are kept for six years from the end of the financial year. The controller is regularly assessing the need for data storing in accordance with its internal code of conduct. In addition, the controller shall take all reasonable steps to ensure that personal data which are inaccurate, incorrect, or out of date for the purposes of processing are deleted or rectified without delay.

8. The Recipients (Categories of Recipients) and Regular Disclosures of the

Personal Data

Personal data will not be disclosed to third parties.

9. The Transfer of Personal Data

The personal data of the register will not be transferred outside European Union or European Economic Area (EEA).

10. The Principles of Protection of the Register

Materials containing personal data shall be kept in locked premises to which only designated and authorized persons have access. The database containing personal data is held on a lockable server, which only designated and authorized persons have access. The server is protected by an appropriate firewall and technical protection. Access to databases and systems is only possible with separately issued personal usernames and passwords. The controller shall limit the access rights and authorizations to the information systems and other storage media so, that the data can only be viewed and processed by persons who are necessary for their lawful processing. In addition, database and system access transactions are recorded in the log data of the controller’s IT system. The employees of the controller and other persons processing data are committed to confidentiality and to keep the information they have obtained when processing personal data confidential.

11. Rights of the Data Subject

The data subject has the following rights under the European Union’s General Data Protection Regulation:

 The data subject shall have the right to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and the following information:

i. the purposes of the processing,

ii. the categories of personal data concerned,

iii. the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations,

iv. where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period,

v. the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing,

vi. the right to lodge a complaint with a supervisory authority,

vii. where the personal data are not collected from the data subject, any available information as to their source (GDPR 15 art.).

This described basic information (i) - (vii) is provided to the data subject in this statement

 The data subject shall have the right to withdraw his or her consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal (GDPR 7 art.),

 The data subject shall have the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement (GDPR 16 art.),

 The data subject shall have the right to obtain from the controller the erasure of personal data concerning him or her without undue delay and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies:

i. the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed,

ii. the data subject withdraws consent on which the processing is based, and where there is no other legal ground for the processing,

iii. the data subject objects to the processing on grounds relating to his or her particular situation, and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing for direct marketing purposes

iv. the personal data have been unlawfully processed,

v. the personal data have to be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject (GDPR 17 art.).

 The data subject shall have the right to obtain from the controller restriction of processing where one of the following applies:

i. the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data,

ii. the processing is unlawful, and the data subject opposes the erasure of the personal data and requests the restriction of their use instead,

iii. the controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defense of legal claims,

iv. the data subject has objected to processing on grounds relating to his or her particular situation, pending the verification whether the legitimate grounds of the controller override those of the data

subject (GDPR 18 art.).

 The data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, if the processing is based on consent within the meaning of the Regulation and the processing is carried out by automated means (GDPR 20 art.).

 The data subject shall have the right to lodge a complaint with a supervisory authority, if the data subject considers that the processing of personal data relating to him or her infringes this Regulation (GDPR 77 art.).

Requests for the exercise of the data subject's rights shall be addressed to the controller's contact person referred to in paragraph 1.

Right of withdrawal

You have the right to cancel this agreement within 14 days without giving any reason. The withdrawal period ends within 14 days starting from the day you received the last shipment, or in the case of downloadable products, from the moment you received the order.

In order to exercise the right of withdrawal, you must notify us of your decision to cancel the agreement in an unambiguous way (for example, by mail or by email). You can also use our printable return form, but its use is not mandatory.

To comply with the deadline for withdrawal, it is sufficient that you submit your notice of cancellation before the end of the withdrawal period.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

You must return the goods without delay and no later than 14 days after informing us about your decision to withdraw from the contract. The deadline is met if you send back the goods before the period of 14 days has expired.

You are only responsible for the kind of value decrease of the goods that did not result from treatment that is required for determining the nature, properties and functionality of the goods.

Mikäli tuote on kadonnut tai vioittunut kuljetuksen aikana tai se ei muuten vastaa tilaustasi, tulee sinun ilmoittaa virheestä viimeistään 14 päivän kuluessa kirjallisesti Peruutusoikeus ja palautusehdot -kohdassa mainittuun osoitteeseen tai soittamalla yhteystiedoissa mainittuun puhelinnumeroon. Jos paketti on selvästi vaurioitunut kuljetuksessa, teidän täytyy tehdä välittömästi asiasta reklamaatio valitsemanne toimitustavan kuljetusyhtiölle.
